To this end, the Turkish government has recently taken a new step within the scope of the Notification Act. This is a regulation that has been in force since 1 January 2019, whereby certain target groups are required to be in possession of an electronic mailing address (electronic notification), the so-called 'E-tebligat adresi'.<br />

Under the new regulation, public authorities as well as private companies and sole traders are required to be in possession of an electronic mailing address in order to be able to make all official notifications at this electronic address. This address is issued on request by the local post offices. In the past 15 years, the Turkish government has worked hard to digitize civilian personal data in the country. Now it's time to reap the benefits. Simplifying the well-known Turkish bureaucracy has started. As of 10.07.2019 the legal obligation to place a certified passport photo on the official deed of ownership has been lifted.<br />
<br />
Whatever action you took at the Tapu, it was previously required that you could identify yourself with a recently taken passport photo not older than 6 months in addition to your ID document. The passport photo was stuck in the official transaction books of the cadastral service and had to be signed by the parties with the deed of purchase and delivery.<br />
The purpose of this was to prevent scams. The official on duty was to ensure as far as possible whether the identity of the applicant corresponds to the person who was registered in the deed.<br />
<br />
With the digitization of Turkey, this is no longer necessary. Nowadays getting the very last personal data via the national digital system is a matter of a few minutes. This saves a lot of time and administration for both the civil servant and the citizen.<br />
<br />
However, a passport photo is still placed on the Tapu (read: certified copy of proof of ownership) if one so wishes.<br />

Herewith the government is missing a lot of tax rates, due to the fact that investors are not giving up the fair market value with property transactions. The reason therefore is that the legal transfer fees are calculated on base of the purchase amount that the parties declare independently at the title of deed office. And that's the point where it goes wrong. Actually the basic indication for the purchase value is the municipal current market value, but often the municipal market value differs from the fair market value.<br />

Besides the lost tax rates, the buyer is often the victim of unrealistic purchase amounts, with the result that Turkey can not create a stable trade name on the international real estate market.<br />

So far the imposed measures proved to be ineffective. That is the reason why the Ministry is introducing the obligation of a valuation report starting from <b>4th of March 2019</b>! Before the deed of purchase and delivery can take place, a valuation report with the fair market value of the object must be established by a recognized valuation company, which will serve as the basis for calculating the property transfer fee.<br />

The regulations are laid down in a Land Registry Regulation by the Ministry of Environment and Urban Development (TKGM). In accordance with this regulation, the procedures of purchase and sale of a property will have to deal with a recognized valuation office that has been approved by the government, the so-called "SPK lisanslı uzmanlar".<br />
<br />
With this new regulation, all foreign investors will be subject to the mentioned conditions. The established valuation report has a validation period of maximum of 3 months from the date of issue. Obtaining a new valuation report within those 3 months is not necessary unless there is such a change to the property that will have an effect on the value. In case of buildings who are under construction, the value will be based on the details of a completed object.<br />
<br />
The purpose of the government may be clear, but the remain main question is; whether the intervention of a recognized valuation office will actually benefit the foreigner. On the other hand, it is certainly a fact that the intervention of an recognized valuation office will considerably delay the ownership transactions in a country where the economy is running very fast.<br />

The Turkish Court in question decided that the elected directors of an association of owners have acted criminally reprehensible because they have not properly kept and closed accounting books of the owners' association, officially. Which means that the accounting records has to be closed and approved by a P<b>ublic Notary</b> in Turkey.<br />
<br />
This concerns the formal conclusion of the official books of an association of owners in accordance with Article 36 of the Law on Apartments. Article 36 of this Act stipulates that a director of an association is obliged to keep all official records of the association, such as the agreements, the expenses, the meeting invitations, the powers of attorney and all the briefings with data and overview in time order in an official notarized legalized book that must be closed and approved by a P<b>ublic Notary</b> at the end of each calendar year. This accounting records are in a separate book (<b>Gelir Gider Defteri</b>) than the official decision book (<b>Karar Defteri</b>) in which the decisions of the association are included.<br />

A board member at an Association of Owners is usually an unpaid job. Voluntary work, unless the members decide otherwise. The nomination for a board position takes place at the time of the annual general members meeting. An association is obliged to meet at least once every year. A director must be appointed by an advanced majority of votes. An advanced majority consists of majority in shareholding as well as majority in the number of members present. A director can only be appointed for a period of maximum one (1) year. The board of an association consists of<b> one or three members</b>. (not 2 or 4).<br />
<br />
The appointed board (members) are responsible for correctly recording the accounting records. The administration must be kept in time in a <b>Notary </b>legalized administration book (<b>Gelir Gider Defteri</b>).<br />
<br />
The administration book has to be closed and approved by the <b>Public Notary</b> in Turkey at the end of each calendar year. <br />
When the assembly is closing the year in f.e. April or September. Then the financial year is ending in April or September, before the General Assembly occurs.<br />

There are a lot of reasons as to why a foreigner in Turkey might want to change their name. <br />
Since the existing of humanity it is essential that a person is addressed with a name. Also a legal name has to be used to make the distinction between persons and families.<br />

A first and last name is a legal and also unique to identity of a person within the society.<br />
When a person does not agree with his / her name, this person has the right to change his / her name in court.<br />
Examples of reasons are: difficulty in pronouncing, ridiculous, asking questions, creates annoyance, unethical, leads to confusion, meaningless, gender reassignment, bad reputation of the family, forbidden name, and so on.<br />
This article as such does not concern the above-mentioned ponderous reasons, but rather situations in which foreigners, desired or undesirable, have become involved during the acquisition of the Turkish Nationality (the Turkish Kimlik).<br />

It is that Turkey has had a strange policy in granting Turkish citizenship to foreigners and provided foreigners a Turkish name when they were granted Turkish citizenship.<br />
Foreigners often got a new Turkish name next to their own name or even instead of their own name. The explanation was that a Turkish citizen could not have a foreign name or foreign character characters in their own name. <br />
The unsuspecting foreigner did not have any knowledge of the legal consequences that this could have on his life. <br />
Technically, a second personality was created next to the identity that the foreigner already had. <br />
In my opinion a violation of the personality rights.<br />

<strong>A practical example:</strong><br />
Mrs. Sarah Koster has got a Turkish surname after her marriage with a Turkish citizen.<br />
She is registered as Sarah Selma Bal. However, her name is simply Sarah Koster on her foreign passport. After 20 years of marriage she ends up in a divorce and gets her maiden name Koster back. <br />
<br />
After the divorce procedure the added Turkish name 'Selma' is not included in the court decision.<br />
Mrs. Sarah Koster has to start a separate name change procedure. Another option is to keep the name Selma. Usually a legal procedure has to be started in your own country, to register the name Selma next to your own name.<br />

Recently changes of the Turkish Name Act, has caused that this policy is no longer applied. But the legal situation for those who have received a Turkish name remains unchanged.<br />
If desired, a short court procedure to Civil Affairs, is needed to change your name. The obligation according to this energy label is implemented in the Energy performance law number 5627 released in 2007. An energy label should enlist details of the energy performance of a building such as energy and insulation properties, energy consumption for heating the house, the efficiency of the heating / cooling system, the level of energy waste and emissions of greenhouse gases. It is based on standard occupant behaviour and standard climatic conditions.<br />
<br />
The energy performance is divided into classifications that are indicated by the letters A to G. Real estates classified with an A label already have taken already many energy saving measures. Real estates classified with a G label still have to take a lot of energy saving measures. <br />
<br />
Pursuant to the above Act buildings with planning permission obtained <b>before 01.01.2011 </b>are considered as existing buildings and the buildings where the building permit <b>after 01.01.2011</b> is obtained as new buildings.<br />
<br />
New construction should at least be built to the standards of energy label with class C. Regarding existing buildings, there is no minimum energy class determined by law. An existing building will be divided among the classes A t / m G to be determined on the basis of the type of energy performance of the building.<br />

A new building that does not meet the energy measures extended to category C will not be eligible for a municipal housing license (Iskan). How can you, as a foreigner pay a fine? Where you have to pay? Can you travel to Turkey if you are convicted to pay a fine? Can you pay in terms? How do you know if the court decision is not disputed, or in other words if it will be executed?</b><br />

The chance that you will be sentenced to pay a fine after getting involved with the Turkish judicial system is very high. Any Turkish juridical decision to pay a fine will be notified to the person in question on the (foreign) residence address. But what happens afterwards? You will be groping in the dark as a foreigner. You will not be explained about the execution proceedings of the decision.<br />

Due to international agreements with foreign authorities, the Turkish decision will be served personally to the convicted person at his/her residence address. Hereafter the appeal period of 7 days is starting to operate. In exception a public prosecutor will appeal within the 7 days. You are able to do the payment in person or by an authorized lawyer at the responsible authority for the execution of the fine (mentioned in the payment order). You can do this by paying off the total amount or make an agreement for terms payment. In sequel the payment receipt must be notified to the department of execution in order that the payment is entered in their system. </div>

A pet can and may not simply be banned by the owners association. I already explained that a legal intervention is a must.<br />

This time I want to talk about, whether it is permissible to make a pet part of a collection procedure. Not that I have been through this situation myself, but last week an old case popped up. It was a remarkable case which at the same time raised an ethical question; Is it allowed to confiscate a living animal.<br />

During a collection procedure in fact a dog was seized, in this case a French bulldog.<br />
An employee had borrowed under false pretenses money from his employer.<br />
The employer had tried in many ways to get his money back, but with no result. In the end he was tired of all the bullying and lies, that out of desperation and in all anger he had the dog of the employee confiscated. The dog had to go with the veterinarian until the depth was paid. The animal protection organization provided the necessary media which attracted the attention of some political figures.<br />
At the end the depth was paid and the dog could return to his owner.<br />

Ethical issue or not, the lawyer succeeded. The collection procedure was effective.<br />

Do you think it is legally regulated that animals can be confiscated, during a collection procedure?<br />
Confiscation is regulated under the Turkish Debt Collection and Bankruptcy Law.<br />
The legislation clearly indicates which things are not exempt. Pets are not included in this list and therefore you would think they can be seized.<br />
<br />
However; since 2004, the Law on Animal Rights in Turkey is valid. According to Article 5 of that law, a companion animal / pet being cared for in a home or garden, can not be seized as a result of a collection procedure, unless the maintenance and care of the pet is part of a commercial purpose. In other words, if the debtor uses the pet to make money, this pet may be seized.<br />
<br />
In short; by law, it is illegal to take pets as a result of a monetary claim.<br />
Back to the case that we have deepened us in.<br />
The lawyer in this case was lucky that the bailiff had no knowledge of the Law of Animal Rights, otherwise the story could have taken another turn. I am afraid that of today they still don’t have any knowledge of this law. :-)<br />

<b>Foreign companies </b><br />

Before the changes to the Tapu law in May 2012 were carried out, foreign companies could without difficulty purchase detached homes. Buying a house / apartment on behalf of a foreign company was therefore no problem. After the amendments of May 2012, this is no longer possible. With the current change a foreign company may only under special legislation (such as the Petroleum Law, the Energy Act or the Tourism concerns) purchase an uncultivated land under the condition that the company within two years after purchase date has to submit an investment project for the property at the Council of Ministers. The purchase procedure is linked to an authorization procedure by the Council of Ministers.<br />

<b>Foreigner as a natural person </b><br />

Buying a house / apartment as property for a foreign person takes no restrictions with it, provided that the house / apartment is located in a restricted area, according to the Ministry of Defense. However, the Council of Ministers reserve the right at all times to special restrictions or impose further conditions on the purchasing procedures. The legislator, with the legislative amendment of 2012 also has imposed the same construction requirement of two years on the foreigner who is purchasing (undeveloped) land or have already purchased.<br />

<b>The consequences</b><br />
<br />
Rightly you'll wonder what happens when the foreigner or the foreign firm fails to comply with the required conditions, namely the submission of an investment project or when there is not started to build in accordance with the investment project within the specified period. The investment project must be filed within two years after the purchase of a vacant plot in the Cabinet.<br />
<br />
If one officially establishes that a foreigner or foreign company, in possession of a property, is in violation of the rules of Article 35 of the Tapu law, the foreign owner will be urged to sell the property within one year. If the owner itself did not sell the property within the year, the property will be publicly executed.<br />
The execution amount will, after deducting the necessary fees and taxes, be paid to the owner. Still there are foreigners who purchase undeveloped plots, but in good faith they state the title deeds (Tapu) on name of a Turkish relationship. This situation I experience myself in my practice very often and I discourage this strongly. Any agreements made between you and your relations are not valid. Get yourself some good information and advise before your dream becomes a nightmare.<br />

But the best solution is not always the simplest solution. Good preparation is half the battle, especially when it concerns traveling with pets. To help you a little bit, we have put the key points for you at a glance:<br />

<li>First it is important to ensure that your pet is examined by a qualified veterinarian. The vet provides the pet with all necessary vaccinations, health certificates and a pet passport. At the moment it is not necessary for Turkey that you pet has a microchip, but that may well change in the future.</li>
<li>The veterinarian must have seen / examined the pet up to 96 hours for transport for the last time.</li>
<li>All papers, passport, health certificates and vaccinations should be seen and stamped by the department of agriculture in the country of departure. </li>
<li>Your veterinarian can tell you exactly which vaccinations are needed. Keep in mind that the vaccinations are not older than 6 months before departure and are provided at the latest 15 days before departure.</li>
<li>Importing ‘’dangerous’’ breeds like Pit-bull Terrier and Japanese Tosa is prohibited.</li>
<li>It is possible for one person to carry up to one cat, one dog, one bird or 10 aquarium fish, without additional charges. When you want to enter multiple animals it is seen as commercial imports and there are other procedures apply. </li>
<li>When the animal is healthy and has the necessary papers, the animal upon arrival in Turkey does not need to be put in quarantine.</li>
<li>Most airlines have their own animal transport policy. Please ask before you book to avoid disappointment.</li>

For retirees this period consisted of maximal 12 months and for non- retirees 6 months.<br />
The temporarily imported car had to leave the country after the date of import and registration; otherwise the owner of the vehicle could get a penalty because of not obeying the law. After this time the vehicle could be brought into Turkey again, however this was only possible after the vehicle was at least for 185 days outside Turkey.<br />
<br />
This temporary import regime satisfied the expectations of the ordinary tourist but not that of expat, the semi permanent retiree or the student living and working in Turkey and planning to use their car for longer than 6/12 months.<br />

The good news is that from 3 October 2015 onwards amendment has been made for the retirees as well non- retirees such as expats / students extending the possibility to use foreign-plated vehicles in Turkey from 6/12 months to 24 months. For both groups, retirees as well the non retirees, the maximal period of 24 months is with the introduction of this amendment applicable. Pay attention to the fact that you need to make a specific request to the customs in this respect.<br />
<br />
The main condition of bringing a foreign plated vehicle into Turkey is that only those who are domiciled for 185 days within the last 6 months outside Turkey.<br />
<br />
In addition not everyone can make use of this car during his stay in Turkey; only the partner, the children or parents of the one that has imported the car may during this period use the car under condition that the importer of the car is staying himself in Turkey. This means that this amendment does not allow importing a car from abroad so that family and friends can easily make use of it. In other words if the importer of the car does leave Turkey without the vehicle within the 24 months, he must station the car at the Customs or leave a written notary commitment to the Customs that no one will use this vehicle . This amendment is perhaps a bit misleading with regard to import cheap cars to Turkey but brought a real advantage for many expats staying in Turkey for a period longer than six months.<br />

noted that the rights concerning the protection of consumers in Turkey was
differently regulated than the current regulation in this respect. I would like
to refer to one of my previous articles regarding these misleading sales
practices. In case of a typically lack of the purchased product, the purchaser
had under determination of the sales agreement, the right to demand his money
back. This was possible within duration of 30 days starting from the moment
that the jewels were sold and delivered to the buyer. In case the buyer did not
inform the seller within these 30 days concerning the lack of the product, dissolution
of the agreement (due to lack of the characteristics of the good) was not
possible anymore and the buyer was bound by that contract. The letter
concerning termination and reclaiming the money back had to be sent to the
seller within these 30 days.<o:p></o:p></span></div>

that have been declared by the seller. This is a real welcome to the right of
the consumers.<o:p></o:p></span></div>

The main difference with the current amendment is the entrance ban that will not be imposed on the illegal staying foreigner who leaves the country on his own initiative. The legislative entrance ban is normally a maximum period of 5 years. But with the amendment the restriction will just be 3 months transition period abroad Turkey, unless the person did apply for a work permit or residence permit within the transition period that is been accepted. In that situation the person will be allowed to enter Turkey without waiting for the 3 months.<br />

The important issue is that the illegal foreigner has to use his own initiative. If the public authorities take measures to deport the person of question, then this person will still have a risk to get an entrance ban for a maximum of 5 years. Once there is a threat regarding the public safety, the entrance ban will be increased with a maximum of 10 years. </div>
